New information has surfaced regarding the type of testimony that important witnesses named by Nnamdi Kanu, the arrested leader of the banned Indigenous People of Biafra (IPOB), are likely to provide in support of his defense against the terrorist charges against him.
The list of witnesses, which was submitted on October 21, is divided into two categories: “ordinary but material defense witnesses (voluntary)” (Category A) and “vital and compellable witnesses” (Category B), which are to be called upon in accordance with Section 232 of the Evidence Act, 2011).
After Monday’s #FreeNnamdiKanu protest disrupted work and business activity in Abuja and other parts of the country, Kanu’s defense is scheduled to begin today at the Federal High Court in Abuja.
Former Attorney-General of the Federation and Minister of Justice Abubakar Malami, former Director-General of the National Intelligence Agency (NIA) Ahmed Rufai Abubakar, former Director-General of the State Security Service (SSS) Yusuf Bichi, former Minister of Defense Gen. Theophilus Danjuma (rtd), and former Chief of Army Staff Lt. Gen. Tukur Buratai (rtd) are on the Category B list of the document, which Kanu personally signed.
The list also includes former Abia State Governor Okezie Ikpeazu, Lagos State Governor Babajide Sanwo-Olu, Imo State Governor Hope Uzodinma, Federal Capital Territory Minister Nyesom Wike, and former Ebonyi State Governor and Works Minister Dave Umahi.
Malami is anticipated to testify on orders and authorizations related to “the defendant’s extraordinary rendition, operations, custody conditions, and compliance with legal procedures,” according the court files.
Buratai will provide testimony regarding “the chain of command authorizing the military operation and the 2017 invasion of the defendant’s residence.”
Similar to this, Ikpeazu would testify regarding his awareness and administrative role during the 2017 military invasion of Kanu’s home in Abia State, while Umahi is anticipated to discuss the prohibition of IPOB “without a judicial order and its consequences.”
According to the document, Wike will testify on the “Obigbo massacre” that followed the EndSARS protests and the function of security forces under his command, while Uzodinma will testify on the murder of former PDP chieftain Ahmed Gulak, as well as the conclusions and public declaration clearing IPOB.
In order to prove what Kanu’s defense refers to as “a pattern of repression,” Sanwo-Olu is anticipated to appear before the EndSARS judicial panel, specifically regarding the Lekki Toll Gate incident.
The defense claims that retired Gen. T.Y. Danjuma’s 2018 public warning to Nigerians to protect themselves against “infiltrated armed forces” helps contextualize Kanu’s support for self-defense. Danjuma will also testify on this topic.
Two Americans, Bruce Fein and Barry Sutton, are among the other witnesses. They will testify on the illegality of extraordinary rendition and the purported digital tampering of electronic evidence. Additionally listed to testify on the alleged extrajudicial killings of IPOB members are a civil society director and an unidentified witness.
