The Federal High Court in Abuja, presided over by Justice Inyang Edem Ekwo, has rejected the request of Senator Samuel Anyanwu, the National Secretary of the Peoples Democratic Party (PDP), to stop the Independent National Electoral Commission (INEC) from removing him from his position as party secretary.
Instead, the judge told Anyanwu to call INEC and the other defendants in his new case so that their opinions could be heard.
It was understood that Anyanwu filed an ex-parte application with the Federal High Court, asking for a ruling that would forbid INEC or its agents from receiving or acting upon any written submissions or correspondence from the PDP unless he signed them.
Anyanwu further asked Justice Ekwo to stop Ambassador Umar Illiya Damagun from sending any letters, papers, or written submissions to INEC unless they were signed by him in the application, which was submitted by his attorney, K.C.O. Njemanze (SAN).
Following a review of the plaintiff’s arguments, Justice Ekwo acknowledged in a succinct ruling that Anyanwu’s claims had established a case of urgency.

But instead of granting the plaintiff’s request through an ex-parte application, the judge decided to wait for the defendants to speak before making any decisions.
Therefore, he instructed Anyanwu to inform Damagun and INEC about the new lawsuit so they can make an appearance in court and make their case.
Justice Ekwo set a hearing date of February 24 and directed the plaintiff to serve the two defendants with the required court documents.
