A lawyer for the African Democratic Congress (ADC) told a court that the Independent National Electoral Commission (INEC) confirmed that Senator David Mark and Ogbene Rauf Aregbesola were elected as the party’s National Chairman and National Secretary at a meeting on July 29, 2025.

In a video that went viral on X, the lawyer told reporters after a court session that INEC’s position backs up the party’s claim that the National Executive Committee (NEC) meeting happened on that date and led to the current leadership.

He said, “INEC’s position agrees with us that the party did hold a NEC meeting on July 29, 2025, during which Distinguished Senator David Mark and His Excellency, Ogbene Rauf Aregbesola were elected as National Chairman and National Secretary of ADC, respectively.”

He went on to say that INEC not only knew about the meeting, but also confirmed that it would be there.

The lawyer said, “They also confirmed in their report that they went to the NEC meeting and that Senator David Mark and Aregbesola were elected as National Chairman and National Secretary.”

He said that INEC wrote down what happened at the meeting and sent a report to the court as proof.

“They wrote a report, which is the one they sent. He said, “So INEC agrees with us on this issue.”

The lawyer said that the plaintiff’s claims were baseless and had no evidence to back them up.

He said, “The plaintiff’s case is based on gossip, which is an activity that never happened.”

He said, “Their argument is that Senator David Mark and Aregbesola came out on July 22, 2025, but we say no, you don’t have any proof.”

He said, on the other hand, that the party has papers to back up its claim.

“We have proof that the party sent INEC a notice of the NEC meeting on July 4, 2025, which will be held on July 29, 2025. The meeting took place on that date. He said, “INEC was there and made a report.”

The lawyer said that the evidence in front of the court clearly backs up the party’s case.

He said, “We have evidence in court to back up our claim that the meeting took place on the 29th, but they don’t have any documents to back up their claim.”

He also asked if the plaintiff had the right to file the case.

“What is the locus of the person who filed this matter? “He’s not an official of the party; he’s just a member,” he said.

The counself said that people can’t sue over internal party matters because of Supreme Court decisions.

He went on to say, “The Supreme Court is very clear that no one has the right to take such action on issues that have to do with the internal affairs of a political party, and no court has the power to hear it.”
