In Abuja, the Federal High Court postponed the trial of Senator Natasha Akpoti-Uduaghan of Kogi North till November 24 due to the absence of Justice Mohammed Umar, the sitting judge, on Monday.
The judge was apparently unavailable because the #FreeNnamdiKanuNow demonstration, spearheaded by activist Omoyele Sowore, interfered with court operations throughout the Federal Capital Territory.
The trial of Senator Akpoti-Uduaghan was among the scheduled cases that were halted Monday due to the lockdown of Justice Umar’s courtroom, according to sources.
The trial was later rescheduled until Tuesday, and the court set the start date for November 24.
The development followed the case’s initial October 21 date after it was adjourned on September 22 after the defense team’s objection caused the proceedings to halt.
According to reports, on June 30, Senator Akpoti-Uduaghan, who represents the Kogi North Senatorial District, was arraigned on a six-count charge brought by Mohammed Abubakar, the Director of Public Prosecution of the Federation (DPPF), over alleged cybercrime offenses.
Following her not guilty plea, Justice Umar granted her bail and postponed the case to September 22 in order to begin the trial.
Ehiogie West-Idahosa (SAN), the defense attorney, brought up a preliminary objection, contesting the court’s jurisdiction, when prosecution attorney David Kaswe tried to introduce his first witness.
West-Idahosa said that the Attorney General of the Federation’s (AGF) purported misuse of prosecutorial authority was the main point of contention, not the charge’s content.
Additionally, he expressed his displeasure that the defense team had not received copies of the prosecution’s witness statements prior to the trial.
“We have already contested the court’s jurisdiction by filing a notice of preliminary objection. The defense attorney stated, “It is against the prosecution’s process, not the charge itself.”
Although Kaswe asked the court to move forward with the trial in spite of the objection, Justice Umar decided that the case could not move forward until the prosecution had given a formal response.
Charges Made Against the Senator
In violation of the Cybercrimes (Prohibition, Prevention, etc.) Amendment Act, 2024, the prosecution charged Akpoti-Uduaghan with electronically disseminating false and harmful information in the case designated FHC/ABJ/CR/195/2025.
On April 4, she was accused of accusing Senate President Godswill Akpabio of ordering former Governor Yahaya Bello to have her assassinated at a public event in Ihima, Kogi State.
She allegedly reiterated the accusations in a televised interview, according to the prosecution, claiming that both men plotted to have her killed for political purposes.
The charging sheet states that the words were meant to “incite, incite, endanger lives, and breach public peace.”
It is anticipated that Justice Umar will rule on the defense’s preliminary objection prior to the start of the trial.
Both parties are anticipated to present more arguments before the court on November 24, when the case will recommence.
