An order for Wunmi, the wife of late singer Ilerioluwa Aloba aka Mohbad to be served a notice of a pending DNA test application via substituted means has been issued.
The ruling which was made by a Chief Magistrate Court in Ikorodu was confirmed by the Aloba family’s legal team member Monisola Odumosu.
He stated that the court order was necessary because the court sheriff had notably failed to personally serve the notice on Wunmi on two occasions.
This development follows an application filed by the legal team of to Joseph Aloba, father of the late singer contesting the paternity of Wunmi’s son, Liam.
In the application filed before the Family Court, Joseph Aloba’s legal team prayed that the court grant and order against Wunmi to present herself and baby Liam for a DNA test at any recognized laboratory in Lagos.
The petition filed by the legal team representing Joseph Aloba also sought an order to serve Wunmi the court papers for the DNA by posting all the originating processes in the suit on the last known address of the respondent.
While reacting to the petition filed by Joseph Aloba’s legal team, Odumosu said: “If the process were served on the last-known address of the respondent by Order of the Court, it would constitute good service and she would be aware of the pending suit. The Chief Magistrate granted the order and ordered that the respondent be served by posting the court process on her last known address.
Odumosu who noted in the statement that also the matter had been adjourned till next month for the report of service also recalled that Wunmi had in a viral video, said she was ready for a DNA test, noting that she had never been available for the court sheriff to serve her the originating motion of the court.
