The Federal High Court in Abuja has formally served Professor Mahmood Yakubu, Chairman of the Independent National Electoral Commission (INEC), with a contempt charge brought by the National Rescue Mission (NRM).
On Thursday, June 20, 2025, Ayuba Sule, a court bailiff, served the Form 48—a warning of the consequences of violating a legitimate court order—at the INEC headquarters in Abuja, following a ruling by Justice Obiora Egwuatu on June 17. This is the initial step towards contempt and committal procedures against the INEC chairman.
The court had earlier ordered that service be performed via substituted means, allowing the bailiff to deliver the documents to any member of the INEC staff.
In a statement issued Friday, NRM’s National Publicity Secretary, Mr. Anselem Nebeife, stated that INEC workers originally refused to accept the documents. According to the statement, the bailiff went to the INEC chairman’s office, where officials requested for his identification. After evaluating the materials, the staff referred him to the legal department. There, too, officials refused to accept the service, causing the bailiff to leave the paperwork in front of the department.

Mr. Oladimeji Ekengba, NRM’s counsel, filed an ex parte motion for substituted service, which was granted. He claimed that INEC and its chairman violated a mandamus ruling issued on March 5th, which directed them to acknowledge the outcome of an emergency convention that elected Chief Edozie Njoku as NRM leader.
Mr. Adebayo Wasiu’s affidavit indicated that INEC ignored the court order despite being aware of its existence. The affidavit stressed the need of upholding the court’s authority, pointing out that Form 48 requires the chairman to justify why he should not be imprisoned for noncompliance.
The court set July 15, 2025 as the date for mention.
