The Independent National Electoral Commission (INEC) is embroiled in a new legal battle after staff members allegedly refused to accept court documents intended for its Chairman, Prof. Mahmood Yakubu. The documents, which included Form 48, a legal notice of the penalties of violating a court order, were to be served as part of contempt proceedings against the INEC boss.
On Friday, June 20, 2025, the National Rescue Movement (NRM) raised the alert in Abuja through its National Publicity Secretary, Anselem Nebeife. According to Nebeife, the court bailiff, Mr. Ayuba Sule, attempted to serve the paperwork at INEC headquarters but was purposely thwarted.
This comes after a ruling by Justice Obiora Egwuatu of the Federal High Court in Abuja earlier this week. The judge had granted NRM’s motion to serve the contempt charge on Yakubu through a substituted means, namely any commission staff member at its national office. This injunction came after the NRM accused INEC of failing to comply with a court ruling that recognized Chief Edozie Njoku as its national chairman.
Nebeife revealed that Mr. Sule first went to the INEC Chairman’s office and identified himself, as staff had requested. After reviewing the court documents, officials reportedly refused to accept them and referred the bailiff to the Legal Department. Another staff member allegedly glanced at the Form 48, returned it, and said, “Can’t you see that this is Form 48? Please, I adore my job ooo.” Frustrated, the bailiff abandoned the documents on the floor of the Legal Department and left the premises.

Legal experts believe Form 48 is an important document that warns of the repercussions of violating a court order. Justice Egwuatu had set July 15, 2025 as the date for the contempt proceedings, emphasizing that the court’s direction to send the notice through any staff member must be followed.
This episode occurs at a time when INEC is being scrutinized for its adherence to court orders and internal changes. The outcome of the contempt proceedings might have ramifications for the commission’s leadership as preparations for the 2027 general election ramp up.
