Indigenous People of Biafra (IPOB) leader Nnamdi Kanu, who is currently in custody, has requested that his trial be moved to a Federal High Court in the South-East or assigned to a different judge if no other Abuja judge is ready to preside over the case save Justice Binta Nyako.
On Wednesday, January 22, after a regular meeting at the Department of State Services (DSS) facility in Abuja, Kanu’s primary attorney, Aloy Ejimakor, revealed his demand in a statement.
This comes after on September 24, 2024, Justice Nyako resigned from the case, stating that Kanu did not trust her to conduct the trial.
Justice John Tsoho, the Chief Judge of the Federal High Court, eventually reassigned the matter to her, which infuriated Kanu.
Ejimakor stated that Kanu believes that the resumption of the trial by Justice Nyako compromises the integrity of the legal system. To make sure she doesn’t oversee the case, he has given his legal staff instructions.
“The main topic of discussion during today’s visitation is the next court date for MNK’s case to continue.
Ejimakor said, “Onyendu has directed the legal team to act quickly to prevent Justice Binta Murtala-Nyako from handling his case. Justice had withdrawn from the case due to the order of recusal entered on 24th September 2024.”

According to Kanu’s legal team, the alleged offenses took place in the South-East, so they also demanded that the trial be transferred there.
“The Chief Judge may transfer the case to Umuahia, Awka, Enugu, Asaba, Port Harcourt, or any other Federal High Court in the former Eastern Nigeria, where the alleged offenses were said to have occurred or had their impact, if no other judge in Abuja is willing to handle the case,” the statement continued.
