The Federal Competition and Consumer Protection Commission, or FCCPC, has been urged by the Socio-Economic Rights and Accountability Project, or SERAP, to look into claims that big tech companies are using opaque algorithms and market dominance to undermine Nigerian media, businesses, and citizens’ rights.
In a February 28, 2026, complaint signed by Kolawole Oluwadare, its Deputy Director, SERAP requested that the FCCPC look into X (previously Twitter), Apple, Microsoft (Bing), TikTok, Amazon, YouTube, Google, and Meta (Facebook).
In a statement released on Sunday, Oluwadare revealed this.
The group called on the commission to “take the necessary steps to ensure compliance with Nigerian laws and international standards and to urgently prevent further unfair market practices, algorithmic influence, consumer harm and abuses of media freedom, freedom of expression, privacy, and access to information.”
A public hearing into the claims of algorithmic discrimination, market dominance, data exploitation, and consumer harm involving the businesses was also requested by SERAP from the FCCPC.
According to SERAP’s complaint, which was sent to Mr. Tunji Bello, the Executive Vice Chairman and Chief Executive Officer of the FCCPC, “Big technology companies function with significant influence over Nigeria’s digital economy and information ecosystem, but they frequently avoid responsibility for the harms they cause.”
“These platforms are able to influence public discourse and market competition without transparency or meaningful oversight thanks to opaque algorithms, offshore revenue extraction, and hidden data practices.”
According to the company, the platforms provide news, information, and commercial opportunities to millions of Nigerians.
It referred to the leading digital platforms as “private gatekeepers of Nigeria’s business and information ecosystem.”
Their market domination and opaque algorithms are human rights violations that jeopardize media plurality, consumer protection, privacy, and the integrity of Nigeria’s democracy, according to SERAP. These concerns go beyond simple economic ones.
It issued a warning that the FCCPC would have to take into consideration “all appropriate legal actions to compel regulatory intervention in the public interest” if it did not take immediate action.
The South African Competition Commission’s investigations into Google, according to SERAP, exposed systemic bias against local media content and resulted in algorithmic transparency, compliance monitoring, and financial restitution.
The group said that Nigerians’ rights were being violated and the nation’s digital economy was being distorted by the corporations’ business strategies and computational technologies.
“The right to privacy is allegedly being interfered with by the widespread collection, retention, and monetization of Nigerians’ personal and behavioral data—often under complicated and ambiguous consent mechanisms,” it stated.
The possible effects of the claimed activities on media freedom, privacy rights, business sustainability, and the integrity of Nigeria’s upcoming elections were a source of concern for SERAP.
The Federal Competition and Consumer Protection Act (FCCPA), including Sections 17 and 18, the provisions of the 1999 Constitution (as modified), and international human rights norms would all be gravely violated if the claims were proven.
The group argued that under Sections 17 and 18 of the FCCPA, the FCCPC has the authority to look into and enforce compliance against behavior that significantly hinders, restricts, or distorts competition in Nigeria.
According to SERAP, algorithmic repression, money diversion to foreign platforms, and limited discoverability continue to plague Nigerian media organizations and content providers, leading to violations of their right to free speech and information access.
The combined impact of purported data concentration, opaque content moderation, biased algorithmic ranking, and market domination, it continued, could seriously stifle competition, hurt consumers, and undermine democratic institutions.
In order to gather evidence from impacted Nigerians, SERAP encouraged the FCCPC to hold a public hearing and launch a thorough inquiry into the alleged behavior.
“Hold a public hearing to collect evidence from impacted Nigerians, including journalists, media organizations, SMEs, content creators, civil society groups, and individual consumers,” the demands further read.
“Require that Nigerian material be treated fairly and transparently, including by disclosing ranking, recommendation, and advertising algorithms and providing quarterly and biannual compliance reports;
“Assure corrective actions for damaged media outlets, such as the creation of a compensation fund;
“Take immediate action to stop market distortion, consumer harm, and privacy and freedom of speech abuses;
“Summon individuals, demand the production of documents, and impose sanctions on the Respondents as needed and in cases where violations of competition, consumer rights, or protection are discovered;
preserving the FCCPC’s ability to ask for more information as needed; and
“Assign any further relief that the Commission deems required to stop unfair market practices and guarantee adherence to Nigerian competition law.”
