The Independent National Electoral Commission (INEC) Chairman, Prof. Mahmood Yakubu, has been summoned by the House of Representatives’ Committee on Electoral Matters.
According to reports, Yakubu was called upon to provide an explanation for the postponement of holding bye-elections to replace open seats in the state and national assemblies.
Following the adoption of a resolution proposed by Jafaru Leko, who represents the Bogoro/Dass/Tafawa Balewa Federal Constituency in Bauchi State, this decision was made on Tuesday at a plenary session.
Worries About Postponed Bye-Elections
Leko emphasized that a number of seats have remained unfilled since the general elections in 2023 as a result of former MPs being appointed to executive positions, resigning, or passing away.
He referenced the 1999 Constitution’s (as amended) Section 68, which requires that these seats be declared empty.
In addition, he cited Section 76(2), which required that bye-elections be held within a month of a vacancy emerging.
“The House is aware that INEC is required by Section 76(2) to hold bye-elections to fill the vacancies and ensure proper representation of the affected constituencies upon the declaration of these seats as vacant,” Leko said.
Effects of INEC’s Postponement
Leko voiced worry that individuals’ constitutional right to representation is being violated and their right to vote is being disenfranchised by the delayed holding of bye-elections.
He cautioned, “This inaction compromises the democratic process, violates the constitutional mandate, and denies affected constituencies their right to representation.”
He also underlined how the delay compromises democratic values and legislative authority, warning that it may create a risky precedent in which adherence to electoral and constitutional standards is no longer required but rather voluntary.
Directives for the House
Following discussion, the House decided on the following:
1. The INEC chairman will be called by the Committee on Electoral Matters to look into the cause of the delay.
2. INEC is required to give a thorough explanation and list the actions taken to resolve the issue.
3. The Legislative Compliance Committee, which will guarantee the resolution’s implementation.
4. Within four weeks, a report for additional legislative action must be filed.
