The Supreme Court ruling on the African Democratic Congress, ADC, should not be a cause for celebration, says Senior Advocate of Nigeria, .
Speaking during an interview on Arise Television’s ‘Morning Show’, Maduabuchi said nothing has been concluded.
He was reacting to the apex court’s decision of April 30, which nullified the order of the Court of Appeal that prohibited the recognition of David Mark as National Chairman of the ADC.
The Supreme Court, led by Justice Mohammed Lawal Garba, said the order was not sought by any of the parties in the matter, and so, the Court of Appeal ought not to have made such an order.
“In my view, the ADC had no business at the Supreme Court,” Maduabuchi said. No decision of the Federal High Court from which an appeal lies.
“The Court of Appeal went beyond its jurisdiction in making an order that no one sought. The status quo should be maintained. The Court of Appeal went one step further in coming to the right decision that there was no proper appeal by the David Mark faction.
That was not right. In the case of David Mark, INEC acted on the order of the Court of Appeal and was on solid ground. “The order of the Appellate Court was status quo ante bellum not status quo.
